Rebecca Silverhart

Overview

After spending a number of years in the health technology industry, Rebecca is a strong proponent of innovation and eager to support clients in the development and protection of their intellectual property. Recognizing the global nature of today's markets and the often untapped value in commercializing intellectual property, Rebecca has experience managing and growing clients' intellectual property portfolios and has obtained intellectual property protection for clients in Canada, the United States, Europe, and Asia.

Rebecca's practice encompasses all areas of intellectual property law and, in particular, she provides legal services in patent and industrial design, IP contracts and enforcement, and trademarks and branding.

Patent and Industrial Design

Rebecca assists clients with obtaining exclusive rights to make, use, and sell patentable inventions and original designs by preparing and filing patent and industrial design applications, respectively. Rebecca also responds to examiner objections, in order to ensure that clients receive the appropriate level of protection for their invention or design.

IP Contracts and Enforcement

Rebecca helps clients safeguard and commercialize their intellectual property by preparing, reviewing and advising on licensing agreements as well as intellectual property provisions in general legal contracts, such as agreements of purchase and sale.

Rebecca also drafts cease and desist letters for clients, in order to notify unlawful users of their infringing activities and to dissuade them from further infringement.

Trademarks and Branding

Rebecca advises on all aspects of brand protection and the enforcement of trademark rights. She has experience preparing and filing trademark applications, including conducting trademark clearance searches and providing opinions on trademark registrability. She also manages trademark cancellation and trademark opposition proceedings, and works with clients to develop targeted strategies in order to best protect and enforce their brand rights.

Rebecca has experience providing branding advice for goods and services across various industries, such as consumer packaged goods, cosmetics, clothing and fashion, health and nutrition, building and construction, oil and gas, and technology and software.

Past Legal Employment

Prior to joining Heer Law, Rebecca articled and worked as an associate lawyer at a boutique IP law firm in Toronto (Pnc IP Group Professional Corporation, formerly Pain & Ceballos LLP). As a law student, Rebecca summered at the Canadian Intellectual Property Office (CIPO), where she adjudicated trademark opposition and cancellation proceedings and drafted Trademarks Opposition Board (TMOB) decisions.

Rebecca was called to the Ontario Bar in 2015.

Legal Education

Rebecca graduated from the University of Ottawa, Faculty of Law, Common Law section. While in law school, Rebecca focused her studies on intellectual property and completed an academic exchange at the University of Southampton, where she studied United Kingdom (UK) and European Union (EU) intellectual property law.

Pre-Law Education

Rebecca graduated with distinction from Western University and holds an Honours Bachelors of Arts, Double Major in Kinesiology and Psychology.
